UK employers are not generally required to employ an HR professional or create an HR department. But employment responsibilities begin as soon as you employ people. Even a very small business needs a reliable way to issue the right documents, keep records, manage absence and performance, deal with grievances or disciplinary issues, and make employment decisions fairly.
Many owners first ask about HR when the business reaches 10, 20 or 50 employees. In practice, there is no single headcount at which HR suddenly becomes necessary. A five-person team can encounter a serious grievance, long-term sickness absence or a difficult dismissal. A 30-person business with experienced managers and good systems may run smoothly for months.
The more useful question is: how much employment risk, administration and management time is the business carrying — and who is responsible for it?
What does a small employer have to manage?
Some obligations arise from the first employee, regardless of whether the business has an HR function. Employers must provide the required written employment particulars, carry out appropriate right-to-work checks, meet workplace pension duties where applicable and usually maintain Employers’ Liability insurance.
Health and safety duties apply to every business, and the Health and Safety Executive says a health and safety policy must be written down once the business has five or more employees.
These responsibilities sit with the employer. Using HR software, an accountant, a manager or an outsourced adviser can help administer them, but it does not remove the employer’s responsibility for the underlying decisions.
What does HR look like in a very small business?
For a business with only a handful of employees, a full-time HR hire would often be disproportionate. The basics can usually be handled through a combination of good documentation, clear ownership and access to advice when needed.
- Accurate written terms and offer/onboarding documents.
- A small set of policies that match how the business actually operates.
- A secure way to hold employee records and track key information.
- A consistent approach to holidays, absence, performance and conduct.
- Someone who knows what process to follow before an important employment decision is made.
Seven signs your business may need more HR support
- Managers are searching online before every people decision. This often means there is no agreed process or trusted point of reference.
- Contracts and policies do not match reality. Documents copied years ago can become disconnected from working patterns, benefits, commission, remote working or actual management practice.
- Employee issues are being dealt with differently by different managers. Inconsistency can create avoidable risk and undermine confidence.
- Absence, performance or conduct issues are drifting. Problems that are not addressed early often become harder to manage later.
- Recruitment is accelerating. Fast growth creates more onboarding, documentation, probation and manager-support requirements.
- Directors are spending too much time on HR administration. The opportunity cost can become larger than the cost of external support.
- You are hesitating before necessary decisions because you are unsure of the process. Good HR should help a business make decisions properly, not prevent it from making them.
What are the main support options?
| Option | Strength | Limitation | Often suits |
|---|---|---|---|
| Owner/manager-led | Low direct cost and strong knowledge of the business. | Time pressure and limited specialist knowledge. | Very small teams with simple needs and good processes. |
| HR software | Organises records, leave and workflows. | Cannot replace human judgement in complex cases. | Businesses needing better administration. |
| Ad-hoc consultant | Expert help when a specific issue arises. | The adviser may have little prior context and cost can be unpredictable during a difficult case. | Occasional, well-defined needs. |
| Retained/outsource HR | Continuity, predictable access and ongoing context. | Requires an ongoing budget and careful scope comparison. | Growing SMEs without an internal HR function. |
| In-house HR | Dedicated internal resource and close operational involvement. | Higher fixed cost and reliance on the capability of the individual/team. | Businesses with enough ongoing work to justify a dedicated function. |
Does headcount matter?
Yes, but it should be treated as an indicator rather than a rule. More employees usually mean more recruitment, absence, holiday, performance and employee-relations activity. There are also specific legal thresholds in some areas — the written health and safety policy requirement at five employees is one example.
For Guardian Forge’s core market of 1-50 employees, the most common gap is often between “the directors manage HR themselves” and “we need a full internal HR function”. Outsourced support can occupy that middle ground.
What is the minimum sensible HR infrastructure?
- current contracts/written particulars for the workforce;
- a handbook or accessible policy set proportionate to the business;
- clear absence, disciplinary and grievance processes;
- secure employee records and clear data-handling responsibilities;
- repeatable recruitment and onboarding steps;
- manager guidance for performance, conduct and workplace concerns;
- a route to obtain specialist help before higher-risk decisions.
The exact shape should reflect the organisation. A hospitality business, professional-services firm, warehouse and remote technology company do not need identical policies or processes.
A simple decision test
If the answer is yes, you may already have enough structure for your current stage. If the answer is no — or the answer depends entirely on one busy director — strengthening HR support is worth considering.
